WASHINGTON (AP) — AP source: HHS Secretary Kathleen Sebelius resigning after rocky health care law rollout.



WASHINGTON (AP) — Health and Human Services Secretary Kathleen Sebelius is resigning from the Obama administration after the rocky rollout of President Barack Obama’s signature health care law, a White House official said Thursday.
The official said Obama was nominating Sylvia Mathews Burwell, the director of the Office of Management and Budget, to replace Sebelius. The official was not authorized to discuss Sebelius’ resignation ahead of the formal announcement and requested anonymity.

But Sebelius’ relationship with the White House frayed during last fall’s rollout of the insurance exchanges that are at the center of the sweeping overhaul. The president and his top advisers said they were frustrated by what they considered to be a lack of information from HHS over the extent of the website troubles.

March 14: High-risk pools extended. The special, temporary coverage for people with serious pre-existing conditions — which was supposed to last only until the health insurance exchanges were in place — was extended a third time for another month.

Feb. 10: Employer mandate delayed. This time, businesses with between 50 and 100 workers were given until 2016 to offer coverage, and the mandate will be phased in for employers with more than 100 workers.

Jan. 14: High-risk pools extended. The high-risk insurance pools, which originally had been slated to close Jan. 1, had already been extended once.

Dec. 24: Enrollment deadline extended. In a message on, customers were told they could get help finishing their Jan. 1 applications if they were already in line on Dec. 24.

Dec. 12: Enrollment deadline extended. Customers on the federal enrollment website were given nearly two more weeks to sign up for coverage effective Jan. 1.

Nov. 27: Small Business Health Options Program (known as SHOP) delayed. Online enrollment for the federal health insurance exchanges for small businesses was delayed.

Nov. 21: Open enrollment delayed for 2015. The administration pushed back next year’s enrollment season by a month.

July 2: Employer mandate delayed. The administration declared that it wouldn’t enforce the fines in 2014 for businesses with more than 50 full-time workers who don’t offer health coverage. The fines were pushed back to 2015.

Nov. 15, 2012: Exchange deadline delayed. The Department of Health and Human Services gave states an extra month to decide whether they would set up their own health insurance exchanges — a decision it announced just one day before the original deadline.

OBAMA: You know, my main priority right now is making sure that it delivers for the American people. And what we…

OBAMA: We’ve got three million young people under the age of 26 who have signed up on their parents’ plan. And so what we’re constantly figuring out is how do we continue to improve it, how do we make sure that the folks who don’t have health insurance can get health insurance…


OBAMA: — and those who are underinsured are able to get better health insurance.

O’REILLY: And I’m paying Kathleen Sebelius’ salary and she screwed up.

OBAMA: Oh, Bill, you’ve got a long list of my mistakes of my presidency…

OBAMA: But this is — this is one that I regret and I’ve said I regretted, in part because we put in a grandfather clause in the original law saying that, in fact, you were supposed to be able to keep it. O’REILLY: I’m asking you whether you were told…

OBAMA: We — we revealed to the American people exactly what we understood at the time. The notion that we would hide the ball for political purposes when, a week later, we all said, in fact, there was a terrorist attack taking place the day after, I said it was an act of terror, that wouldn’t be a very good cover-up…

O’REILLY: — because I don’t know what happened there and I’m hoping maybe you can tell us. Douglas Shulman, former IRS chief, he was cleared into the White House 157 times, more than any of your cabinet members, more than any other IRS guy in the history, by far.

OBAMA: Mr. Shulman, as the head of the IRS, is constantly coming in, because at the time, we were trying to set up the, uh, and the IRS…

OBAMA: Number two, we’ve also got the IRS involved when it comes to some of the financial reforms to make sure that we don’t have taxpayer funded bailouts in the future. So you had all these different agendas in which the head of the IRS is naturally involved.

OBAMA: I do not recall meeting with him in any of these meetings that are pretty routine meetings that we had.

O’REILLY: “Mr. President, why do you feel it’s necessary to fundamentally transform the nation that has afforded you so much opportunity and success?”

OBAMA: I don’t think we have to fundamentally transform the nation…

OBAMA: I think that what we have to do is make sure that here in America, if you work hard, you can get ahead. Bill, you and I benefitted from this incredible country of ours, in part, because there were good jobs out there that paid a good wage, because you had public schools that functioned well, that we could get scholarships if we didn’t come from a wealthy family, in order to go to college.

O’REILLY: Right.

OBAMA: That, you know, if you worked hard, not only did you have a good job, but you also had decent benefits, decent health care…

O’REILLY: They’re cutting me off…

OBAMA: — and for a lot of folks, we don’t have that. We’ve got to make sure that we’re doing everything we can to expand the middle class…

O’REILLY: All right…

OBAMA: — and work hard and people who are working hard can get into the middle class.

O’REILLY: I think — I — you know, I know you think maybe we haven’t been fair, but I think your heart is in the right place.

DEPLORABLE! Obamacare Website HealthCareGov Is In Violation Of Federal Security Law

Time to pull the plug on the criminal Regime’s “hacker’s wet dream”; Obamacare, otherwise deceitfully known as the ‘Affordable Care Act’.

Charles C. Johnson of The Daily Caller reports:

The bureaucracy tasked with Obamacare implementation may be violating a law that requires government agencies to keep private information safe.

Under the the Federal Information Security Management Act (FISMA), the Department of Health and Human Services’ Center for Medicare and Medicaid Services (CMS) is required to have an “Authority to Operate,” or ATO. In order to receive an ATO, new information tech systems must perform a set of tests, including “Security Control Assessments” (SCA).

But according to CMS’s 2014 budget request, no such security assessment took place. The Federal Healthcare Marketplace website was rolled out without full end­-to­-end testing.

Indeed, the large number of new systems created because of Obamacare created a backlog of testing. CMS could not complete its required security. Failing to complete the required means no ATO, and hence a violation of federal law under FISMA.

FISMA was enacted in 2002. Under FISMA, federal agencies are required: “to develop, document, and implement an agency­-wide program to provide information security for the information and information systems that support the operations and assets of the agency, including those provided or managed by another agency, contractor, or other source.”

Centers for Medicaid and Medicare Services is responsible for the oversight and implementation of the Federal Healthcare Marketplace website and associated systems.

Documents obtained by The Daily Caller reveal the federal violations. [...]

Washington (CNN) – Democratic Senate Majority Leader Harry Reid, one of Obamacare’s architects and staunchest supporters, is also the only top congressional leader to exempt some of his staff from having to buy insurance through the law’s new exchanges.

Reid is the exception among the other top congressional leaders. GOP House Speaker John Boehner, House Democratic Leader Nancy Pelosi and Senate Republican Leader Mitch McConnell have all directed their staffs to join the exchange, their aides said.

In the charged atmosphere surrounding Obamacare, Reid’s decision only gives Republicans more ammo to attack Democrats already suffering politically from the law’s botched rollout.

In September, Reid told reporters, “Let’s stop these really juvenile political games — the one dealing with health care for senators and House members and our staff. We are going to be part of exchanges, that’s what the law says and we’ll be part of that.”

“I’m sure that regular Americans who just lost their insurance will feel comforted to know that Senator Reid’s staff gets to keep their government plan,” a senior GOP Senate aide said. [...]

(NPHR) –Nancy Clark had high hopes when the federal insurance marketplace opened for business Oct. 1. A member of the NH Health Exchange Advisory Board and a strong supporter of the Affordable Care Act, Clark owns Glen Group, a small advertising agency in North Conway. She’s always offered health insurance to employees and their families, even as premiums increased by double digits every year.

I’ve turned down the heat, the lights,she says. “But we never, ever took health care off the table.

Until now.

When Anthem told Clark premiums for her eight employees would go up 39 percent in 2014, she checked out the plans available through the Small Business Health Options Program, where companies with fewer than 50 employees can shop for group coverage. Those plans were less expensive, but would still increase Clark’s premiums by 14 percent.

Clark then compared the price of individual policies available at to what she currently offers. She figured she could save 13 percent, or about $15,000, by discontinuing her group plan. She told her employees to pick a policy offered on the marketplace, and she’ll increase their pay to cover half the cost of the premiums.

Nancy Clark is the owner of Glen Group, a small advertising and marketing agency in North Conway, New Hampshire, which serves people from across the state. And now that the economy and Nancy’s business are getting stronger, she says: “My hope is that in 2012 we will take that tax credit and I would like to use it to pay down deductibles or even to pay one co-pay or two co-pays.

Nancy first heard about the Affordable Care Act tax credit from her accountant. Her message to other small businesses:  Are not aware of it, I would say absolutely ask your accountant because every tax credit is meaningful.

“The Affordable Care Act from a small business perspective to me is a step in the right direction, and I’m delighted by that” Nancy tells us. “The health care law matters. It makes a difference in my life. And in the lives of her employees.
